'Innocent' driver taken for testing after overnight shooting

ATLANTA (CBS ATLANTA) -

Atlanta police took two men into custody after a shooting outside a gas station early Tuesday, including a driver who had nothing to do with the original incident.

Officers responded at about 1 a.m. to reports of shots fired at the Shell station, located on Northside Drive near Interstate 75. Police believe the occupants of three cars had been involved in a drug deal when someone fired shots.

"Two occupants were inside of a silver vehicle and attempted to flee from the gunfire and rolled out into the roadway," said Capt. Tim Peek. "He  struck an innocent vehicle as it was traveling on Northside Drive."

But it turned out, that "innocent" driver wasn't so innocent, police said.

"Unfortunately, at this point, although he was not involved in the shooting, it appears he very well may have been impaired by alcohol, so he was transported for testing," Peek said.

Detectives were trying to determine the identify of the occupants of two other cars that fled before police arrived.
