The vehicular homicide trial has been declared a mistrial.
Daniel Leary was charged with motor vehicle homicide while under the influence of alcohol and negligent or reckless driving in the crash that killed David Laduzenski in West Springfield.
Leary's lawyer moved for a mistrial when the prosecution began to play the video tape of Leary's booking at the West Springfield police station.
During the video, an officer is heard saying the charges, when possession of a Class D substance is mentioned.
Before the trial started, the judge ruled that there would be no reference to the cocaine charge.
So the judge granted the mistrial.
