CLEVELAND, OH (WOIO) -

The Cleveland dad shot while waiting to pick up his child outside a Cleveland school on the city's east side, is improving.

On Friday, Elliot Miller's condition was listed as fair at MetroHealth Hospital.

Miller, a Cleveland Muni Court Bailiff, was shot Monday afternoon outside Citizens Academy on Hampden Avenue.

Cleveland Police say Miller and his wife were in the car line when an unknown suspect jumped in their back seat.

The suspect pointed a gun at them and demanded their cell phones. Miller's wife handed over hers, Elliot did not. The suspect then shot him in the back and fled.

He remains on the loose.
