State lawmaker looks to make 'revenge porn' illegal

The creator of a revenge porn site is facing several federal hacking charges related to his website. Now Arizona state legislators are working to strengthen our own cyber laws.
 
The 27-year-old creator of www.isanyoneup.com, Hunter Moore, is facing hacking and conspiracy charges, accused of paying his co-defendant to hack into women's emails accounts to get nude photos for his site.

What exactly is revenge porn? If you're seeing someone and you send them an explicit photo or video, but things go sour, you may one day see it online from your scorned lover. There isn't a whole lot of recourse for victims - something one state lawmaker is hoping to change.
"Obviously he's somebody who enjoys hurting other people," said state representative JD Mesnard of Chandler. He is planning on introducing legislation early next week to make it illegal.

"If you basically come into possession of a picture, you take it, I suppose, or it's sent to you, unless you get written permission from that person it is not OK to post it online," Mesnard said. 

California and New Jersey both have laws against revenge porn. So why haven't all states adopted their own?

"It deals with two issues," said attorney Jonathan Frutkin. "One is copyright issues but the other is freedom of speech."

Frutkin said victims can send the website what's called a take-down notice. But he said right now, the only other option to get those photos taken down is to sue. 

"Whatever law exists needs to deal with both the protection of the victim, and also the protections of the rights of people who post things online," Frutkin said.

"Our laws are always trying to track with changing technology and usually we're far behind and I'm hoping in this case we won't be so far behind," Mesnard said.
