TUCSON, AZ (Tucson News Now) -

An Oro Valley councilman is speaking out after being accused of domestic violence and violating an order of protection.

Brendan Burns bio states he is a civil defense attorney and a major in the Army Reserves.

Now he is having to defend himself against misdemeanor domestic violence charges filed against him.

Court documents indicate the accusations made by his wife come during tough divorce proceedings taking place right now.

Court documents state Burns is charged with interfering with judicial proceedings, domestic violence and criminal trespass in the first degree.

Court documents state Burns is taking medication for mood disorders and his wife is accusing him of grabbing her arm and pushing her.

Court documents indicate he made a statement to his wife while driving erratically, saying "We are going to die tonight," and he allegedly threatened that if his wife did not give him the credit card, he would be violent in front of the kids.

We contacted Burns for a comment tonight.

He released this statement to us saying: "I am saddened that my divorce and recent personal struggles have become public matters. As is often the case in these emotional situations, I have regrets, but much of the substance of the protective order is untrue, and my wife has already dismissed it voluntarily. My focus is now on my family and healing my relationship with my wife so we can be better parents to our three, young children.  My family hopes for your prayers and understanding as we continue the healing process and we humbly ask for privacy out of respect for our children."
