A father accused of throwing his 7-month-old son off of a Middletown bridge and jumping in himself is scheduled to face a judge on Tuesday.
Tony Moreno, 22, faces a murder charge for the death of Aaden Moreno.
According to court documents, a restraining order was filed against Tony Moreno before the incident. However, it was denied by a judge.
Legal experts told Eyewitness News it was because there was little evidence to justify it.
On July 5, the documents said Tony Moreno sent cryptic text messages to Aaden's mother moments before he allegedly threw the baby off of the Arrigoni Bridge into the Connecticut River.
One message read "enjoy your new life without us."
The documents said Tony Moreno's family rushed to the bridge. That's when police said he jumped the 120 feet into the water.
Police said he survived the suicide attempt.
Tony Moreno is due in Middletown Superior Court sometime Tuesday morning.
