One of the men convicted of the deadly Cheshire home invasion in 2007 will be back in court on Tuesday.
Joshua Komisarjevsky will be resentenced to life in prison.
Steven Hayes was re-sentenced to life in prison last month, now his accomplice in that deadly home invasion, will face the same fate in New Haven on Tuesday.
Joshua Komisarjevsky was originally sentenced to death for his role in the home invasions killings of Jennifer Hawke-Petit and her two daughters, Hayley and Michaela.
Last year, the state Supreme Court banned capital punishment, calling it unconstitutional.
That decision impacts past and future cases, meaning Komisarjevsky will now be sentenced to life in prison, without the possibility of release.
Komisarjevsky is the third of 11 death row inmates in the state to be resentenced.
